The agreement between you and Fish AI.
1. Agreement to Terms
By accessing or using Fish AI services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including business owners who subscribe to our services.
2. Description of Services
Fish AI provides an AI-powered business engine for trade businesses, which may include:
- AI phone answering and call handling
- Lead capture and management
- Website design, hosting, and maintenance
- Google Ads campaign management
- Scheduling and dispatch coordination
- Automated customer communications (SMS, email)
- Reporting and analytics

3. Account and Subscription
To use Fish AI services, you must:
- Provide accurate and complete information about your business
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access
- Be at least 18 years old and have authority to bind your business
4. Fees and Payment
Fish AI pricing includes:
- Setup fee: A one-time fee for initial system build (Digital Construction phase)
- Monthly fee: Ongoing fee for management and optimisation services
Specific pricing is provided in your custom quote. All fees are in Australian dollars and are due as specified in your service agreement. We reserve the right to change pricing with 30 days notice.
5. Cancellation
You may cancel your subscription at any time with 30 days written notice. Upon cancellation, we will provide you with your data and assist with transition. Setup fees are non-refundable. Monthly fees are not prorated for partial months.
6. Your Responsibilities
You agree to:
- Provide accurate business information for AI training
- Review and approve AI responses and scripts before go-live
- Notify us of any changes to your services, pricing, or availability
- Comply with all applicable laws, including the Australian Consumer Law
- Not use our services for any unlawful or fraudulent purpose
- Ensure you have appropriate licences and insurance for your trade
7. AI and Automation Disclaimer
Our AI systems are designed to handle routine calls and enquiries professionally. However, AI technology has limitations. We recommend reviewing call transcripts regularly and providing feedback to improve accuracy. Fish AI is not responsible for misunderstandings or errors in AI-handled communications, though we work continuously to minimise these.
8. Intellectual Property
Fish AI owns all rights to our technology, systems, and processes. You retain ownership of your business data and content. We grant you a limited licence to use our services during your subscription. You grant us a licence to use your business information to provide and improve our services.
9. Limitation of Liability
To the maximum extent permitted by law, Fish AI's liability is limited to the fees you paid in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities. This does not exclude or limit any rights you have under the Australian Consumer Law.
10. Privacy
Your use of Fish AI is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
11. Changes to Terms
We may modify these terms at any time. We will provide notice of material changes via email or through our services. Continued use after changes constitutes acceptance of the new terms.
12. Governing Law
These terms are governed by the laws of Western Australia, Australia. Any disputes will be resolved in the courts of Western Australia.
