Terms of Service

Plain-English website terms for FishAI’s assessment, installation and support work. The accepted quote remains the specific agreement for each job.

1. What FishAI provides

FishAI assesses, installs, configures, tests, documents and repairs AI agent systems for businesses. Work may include a free fit chat, a paid Agent Assessment, a quoted installation, commissioning, training, repairs, upgrades or an optional Agent Care agreement.

Each paid job is governed by the written quote or service schedule you accept. That document defines the scope, price, assumptions, included systems, authority limits and completion criteria for that job.

2. Assessment, quotes and payment

The Agent Assessment is a separate paid service. Its current advertised price is $295 and it is credited toward an installation when the associated installation quote is accepted within the period stated in the Agent Plan or quote.

Installation, repair, upgrade and Agent Care prices are quoted according to scope. Provider subscriptions, usage charges, hardware and licences are separate unless a quote expressly includes them. Payment timing and any deposit are stated in the accepted quote.

3. Customer-owned systems

Where practical, provider accounts, configuration, controls and direct provider billing stay in the customer’s name. FishAI may use reusable methods, templates and installation tooling, but the customer receives the agreed configuration, controls and handover material needed to operate the installed system.

There is no compulsory monthly FishAI fee after handover. Optional Agent Care, later repairs and upgrades are separate services.

4. Commissioning and 30-day support

At handover, FishAI records the agreed tests and results in a commissioning certificate. The certificate is evidence of what was tested at that time; it is not a promise that third-party services will never change or fail.

Unless the quote says otherwise, 30-day commissioning support covers defects in the original FishAI configuration, reasonable tuning within the agreed responsibilities and reasonable operator training. New capabilities, integrations, redesigned workflows, changed provider requirements and new business rules are outside that scope and may be quoted separately.

5. Customer responsibilities

The customer must provide accurate process information, lawful access, suitable provider accounts and timely decisions. The customer remains responsible for its business records, backups, staff and customer obligations, and for reviewing consequential actions until the accepted scope explicitly says otherwise.

Do not give FishAI or an agent access to data or systems you are not authorised to share. Tell FishAI promptly when staff, systems, permissions, policies or business processes change in a way that could affect the installation.

6. AI and third-party limitations

AI can be wrong, incomplete or unpredictable. FishAI designs controls and tests around that fact, but does not guarantee error-free output, uninterrupted operation, a particular business result or continued availability of any third-party provider.

External providers may change their prices, limits, features, terms or availability. FishAI will identify expected provider costs and known dependencies during scoping, but those providers remain responsible for their own services.

7. Authority, access and monitoring

Actions involving money, customer communications, public content, advertising or other material consequences start with customer approval unless the accepted scope expressly grants a narrower tested authority.

Support access must be agreed and may be revoked. During commissioning, FishAI may receive agreed health alerts. After handover, alerts go to the customer by default unless an Agent Care agreement expressly provides otherwise.

8. Changes, cancellation and ending access

Either party may decline work before a quote is accepted. Once work begins, cancellation, work completed, non-refundable provider costs and handover obligations are handled under the accepted quote and Australian Consumer Law.

When support or Agent Care ends, the customer should remove FishAI access that is no longer required. FishAI will provide the agreed handover material and remove its support access where it controls that access.

9. Consumer rights and liability

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

To the extent permitted by law, FishAI is not responsible for indirect or consequential loss, lost profit, or loss caused by inaccurate customer instructions, unauthorised access, customer changes, or third-party provider failure. Any other liability is limited in the manner permitted by law and the accepted quote.

10. Privacy, governing law and changes

Our Privacy Policy explains how information is handled. These terms are governed by the laws of Western Australia. We may update website terms for future work; an accepted quote is not silently changed by a later website update.
